The Best Thing About Applying for the Offshore Partner Visa

Are you planning to apply for a Partner visa or commonly known as the spouse visa or de facto visa, but have unfinished business at home that you still need to take care of?

Packing up your whole life and moving to another country is not easy. You may still have a house, a job and with most, if not all, your family residing at home, packing up your whole life and moving to Australia in a flash of an eye might not be the best option right now. But guess what? It’s OKAY.

Why? Because you can lodge an offshore Partner visa application and it might just be better than lodging an onshore Partner visa!

What You Need to Know About Offshore Partner Visa

Offshore Partner visa applications are less common. In 2016/2017, 38% of Partner visas were lodged offshore against onshore partner visa application which accounted for 62%. The main reason why onshore partner visa application is preferred by most applicants is that it allows them to work, study and remain in Australia until a decision is made on their de facto visa application.

But what a lot don’t realize is the offshore spouse visa (or de facto visa) actually offers more flexibility than you think.

If you’re not ready to move your whole life to Australia straight away, the offshore Partner visa application may be more suitable for your situation.

Let’s Take a Look at the Advantages of Applying for an Offshore Partner Visa that People Don’t Realize.

1.    Faster Processing Times

YES, it’s true. We have been keeping track of the global processing time provided by DoHA and it is clear that the estimated onshore Partner visa processing time is much longer than the estimated offshore Partner visa application processing time.

Currently, the offshore Partner visa processing time compare to onshore Partner visa is as follow:

Visa Subclass 75 per cent of applications processed 90 per cent of applications processed
Partner visa subclass 309 – Provisional visa 12 months 16 months
Partner visa subclass 820 – Provisional visa 17 months 24 months

Check global processing time at: DoHA

Let’s also keep in mind that processing time for spouse visa application can be impacted by application volumes, seasonal peaks, complex cases, incomplete applications AND front-loaded applications. Lodging a front-loaded or complete application can increase your chance of getting your Partner visa application granted much faster than the estimated processing time!

2.    You can still visit Australia during the processing period

One of the biggest and saddest misconceptions is that you cannot visit your partner in Australia during the offshore partner visa processing times. This is wrong!

It is true that when you apply for the offshore Partner visa, you do not get granted a Bridging visa A (BVA). But it doesn’t mean you have to remain overseas for the entire processing period.

Once your offshore Partner visa application is lodged, you can apply for a Visitor visa to come to Australia. If granted, you will be able to spend time with your partner for as long as your visitor visa grant lets you, while your de facto visa is processing.

An important thing worth remembering is you will not have work rights on the Visitor visa and you will still have to be offshore when a decision is made on your offshore Partner visa (subclass 309) application.

If you are onshore when DoHA is ready to make the decision, they will advise you to leave so that they can grant your 309 visa.

3.    Closer to Family and Friends

Moving to another country is already hard enough, the last thing that you’d want to do is to leave your family and close friends behind. The offshore Partner visa will give you extra time to be with them and make every second count before you embark on your next adventure.

It’s also one of the best things to have your friends and family close for support during this application process. De facto visa is a very informative and extensive process and there may be times where things will take an unexpected turn. Having your friends and family at a close distance to support you can make a huge difference.

4.    Extra Time to Get Organised

End a lease, sell a house and other asset or preparing to hand over your work… there may be some loose ends you might need to tie up before moving to Australia. These things often require time and meticulous planning.

Lodging an offshore Partner visa will give you that extra time to sort these things out before moving.

Also, the best thing about the Partner visa is, once your Partner visa is granted you will have unlimited travel rights meaning, you can travel in and out of Australia as many times as you like!

5.    The Best BEST Thing About the Partner Visa

Nothing beats this. The best BEST thing about the Partner visa application is you can be anywhere, in or outside Australia, when DoHA makes a decision on your permanent Partner visa.

Fly to France…Greece…Italy, or if you feel like going back to visit your family at home while your permanent residency in Australia is being processed, you can without having to worry about coming back in time for the permanent visa grant!
